Terms of service

Last updated:

These terms apply when you use the MindHappy app or this website. Using either means you accept them.

What MindHappy is

MindHappy is a gratitude journal. It is a place to write things down. It is not therapy, not medical advice and not a medical device, and it does not diagnose or treat anything. If you are in difficulty, please contact a doctor or a crisis line in your country.

Your account

You need an account to sync your entries. Keep your login details to yourself — you are responsible for what happens under your account. You must be at least 13 years old, or the minimum age where you live, whichever is higher.

Your content

What you write stays yours. You give us only the permission we need to store your entries, sync them between your devices, and show them back to you. We do not claim ownership and we do not publish anything you write.

Paying for Premium

Premium is sold through the App Store and Google Play, and their terms cover the payment. Subscriptions renew until you cancel them in your store account; cancel at least 24 hours before a renewal to avoid being charged for the next period. The lifetime purchase is a one-time payment that does not renew. Refunds are handled by Apple or Google, not by us.

Ads

The free version shows ads. Premium removes them.

Fair use

Please do not try to break the app, reverse-engineer it, resell it, or use it to store anything illegal. We can close accounts that do.

Availability

We work to keep MindHappy running, but we cannot promise it will never be unavailable. Features can change or be withdrawn as the app develops.

Liability

We are liable without limit for intent and gross negligence, and for injury to life, body or health. For ordinary negligence we are liable only where we breach an obligation essential to the contract, and then only for the damage typically foreseeable for this kind of agreement. Nothing here limits any rights you have under mandatory consumer law.

Changes to these terms

If we change these terms we will update the date at the top of this page and, where the change is significant, tell you in the app.

Governing law

German law applies. If you are a consumer, you keep the protections of the law of the country you live in. The EU also runs an online dispute resolution platform, though we would rather you just wrote to us first.
